Pre-Charge

The stage where the most can be done and the least usually is. A complaint has been made, or a notice has arrived, and no charge has been framed yet. What is said in the next few weeks decides how much of the next few years is spent in court.

What instructing us looks like

Every matter differs. These are the steps this practice takes as a matter of course, before anything is filed.

  • We read the complaint and the notice before anyone answers either.

  • Representations to the investigating officer, and to the higher officer where the investigation has gone off the rails.

  • Anticipatory bail moved early, not after the knock on the door.

  • Where the complaint should never have been registered, a quash petition under Section 528 BNSS.
