Divorce Law
India has no single divorce law. Which statute governs a marriage decides the grounds, the waiting period, the maintenance and the court — and for couples married abroad or living apart, it decides which country may hear the case at all.

Every matter differs. These are the steps this practice takes as a matter of course, before anything is filed.
The first question is always which law applies — a petition filed under the wrong Act is time lost, not merely a technicality.
Mutual consent settled in writing before it is filed, so the six-month period runs while the terms hold rather than while they are argued.
Maintenance and custody dealt with together, because in practice they are decided together.

Hindu Marriage Act
Divorce, judicial separation, restitution and nullity for Hindus, Buddhists, Jains and Sikhs under the 1955 Act.
Muslim Divorce Law
Khula, mubarat and the Dissolution of Muslim Marriages Act 1939; mehr and iddat maintenance, and the 2019 Act on triple talaq.
Christian Divorce Law
Petitions under the Indian Divorce Act 1869, including the confirmation the District Court alone can grant.
Special Marriage Act
Inter-faith and civil marriages and their dissolution under the 1954 Act, including the notice period and objections to it.
NRI & Cross-Border Divorce
Recognition of a foreign decree in India, service abroad under the Hague Convention, and proceedings run for a client who cannot attend.
Anti-Suit Injunctions
Restraining a spouse from pursuing the same marriage in a foreign court, and resisting such an order obtained against you.
Alimony & Maintenance
Interim maintenance under Section 24 HMA and Section 144 BNSS, permanent alimony, and enforcement when an order is simply ignored.
Perjury & False Affidavits
Section 340 BNSS proceedings where income, assets or facts have been concealed from the court on oath.
